Welcome to 4Paws Movers ("we," "us," or "our"). These Terms of Service ("Terms") govern your use of our website and our pet relocation and transport services. By booking a transport, requesting a quote, or using our services, you ("Client," "Owner," or "You") agree to be bound by these Terms.
1. Services Provided
4Paws Movers provides ground and air pet transportation, coordination, and cross-border relocation assistance for household pets.
- Customs Clearance Assistance: We coordinate with independent, accredited customs brokers to facilitate border entry into Canada or the United States.
- Currency: All quotes, invoices, and prices listed on our website or issued to clients are in Canadian Dollars (CAD) unless explicitly noted otherwise.
2. Pet Health Prerequisites & Requirements
The health, safety, and welfare of your pet are our highest priorities. To ensure safe transit and regulatory compliance, the Client agrees to the following prerequisites prior to pickup:
Health & Veterinary Clearance
- Veterinary Inspection: Every pet must undergo an examination by a licensed veterinarian within the timeframe mandated by the destination country or transport authority (typically within 10 to 14 days of travel).
- Vaccinations & Treatments: All pets must be up to date on required vaccinations (including Rabies) and pest/parasite treatments according to Canadian Food Inspection Agency (CFIA), Canada Border Services Agency (CBSA), and USDA APHIS standards.
- Fit to Travel: You certify that your pet is in good health and physically capable of enduring the journey. Pets with pre-existing medical conditions must have explicit written clearance from a veterinarian.
- Sedation Policy: We do not accept sedated or tranquilized animals unless explicitly prescribed by a veterinarian with specific written administration guidelines provided to us prior to travel. Sedation can pose severe cardiovascular risks during transport.
Breed & Behavioral Standards
- Aggressive Behavior: Clients must disclose any history of aggression, severe anxiety, or biting tendencies. We reserve the right to refuse or terminate transport if an animal presents a safety hazard to our handlers, drivers, or other animals.
- Brachycephalic (Flat-Faced) Breeds: Breeds prone to respiratory complications (e.g., Bulldogs, Pugs, Persian Cats) may be subject to specific weather, temperature, or travel restrictions.
3. Documentation & Customs Brokerage
- Client Responsibility: The Client is responsible for ensuring all health certificates, rabies records, microchip details, import/export permits, and ownership records are accurate, complete, and provided to us or the assigned customs broker in a timely manner.
- Customs Brokerage Fees: Customs brokers prepare all necessary documentation to meet Canadian Customs and USDA APHIS regulations. All brokerage fees and official government inspection charges are billed directly to the Client or at cost with zero markup by 4Paws Movers.
- Refusal of Entry: 4Paws Movers is not responsible for border delays, quarantine, or refusal of entry resulting from inaccurate, missing, or falsified documentation provided by the Client or veterinary authorities.
4. Service Limitations & Scope
- Uncontrollable Delays: While we make every effort to maintain schedules, 4Paws Movers is not liable for transport delays caused by severe weather conditions, highway closures, traffic accidents, border inspection delays, airline cargo schedule changes, or mechanical failures.
- Emergency Veterinary Care: In the event your pet suffers an unexpected medical emergency during transit, 4Paws Movers is authorized to secure immediate emergency veterinary treatment. The Client agrees to assume full financial responsibility for all reasonable emergency veterinary fees incurred.
5. Payments, Fees, & Cancellations
- Payment Terms: Services must be paid in full 48 hours prior to the scheduled pickup date unless otherwise arranged in writing.
- Third-Party Charges: Government border inspection fees, customs duties, tolls, and direct customs broker fees are the sole responsibility of the Client.
- Cancellation & Refund Policy: Bookings cancelled prior to pickup are eligible for a 50% refund of the total fee. The remaining 50% covers initial transport scheduling, administrative setup, and reserved capacity.
6. Limitation of Liability
To the maximum extent permitted by applicable law:
- 4Paws Movers shall not be liable for indirect, incidental, consequential, or punitive damages arising out of or related to our services.
- Our total liability for any direct loss or injury to a pet, except in cases of gross negligence or willful misconduct, shall not exceed the total amount paid by the Client for the transport service in question.
7. Client Representations
By booking our services, you represent and warrant that:
- You are the lawful owner of the pet or have full legal authorization from the owner to arrange transportation.
- All information provided regarding the pet's age, breed, medical history, and behavioral traits is accurate and truthful.
8. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.
